Thank you for visiting the NYSOH DOC Uploads Application (or "App") for mobile devices for the NY State of Health Marketplace ("NYSOH" or the "Marketplace"). This App is designed to allow you to submit documents to the Marketplace that are required to process your application for health insurance coverage. As used herein, "we" refers to the Marketplace and the software developers with whom it contracts to provide the App.

NY State of Health is committed to ensuring the confidentiality of your information. This privacy statement describes how NYSOH Doc Uploads may gather, use or disclose information about you and governs your use of the NYSOH Doc Uploads App. Please read this document carefully before you access and use the App.

You provide personal information voluntarily when you submit verification documentation through the NYSOH Doc Upload Application. "Personal information" refers to personally identifiable information such as name, address, date of birth, and/or social security number, which alone, or when combined, may be used to identify you. The documentation, including personal information, volunteered by you to complete an application for health insurance coverage is used by the Marketplace to process your application.

The Marketplace safeguards the personal information it receives with operational, administrative, technical, and physical safeguards to prevent unauthorized or inappropriate access, use, or disclosure. Policies to protect the confidentiality of personal information are based on applicable law and standards for state-based health insurance marketplaces.

How We Use and Share the Information CollectedReturn to the top

The Marketplace uses personal information it receives from applicants for health insurance coverage to verify the identity of the applicant, validate eligibility for coverage and allow you to enroll in the health insurance programs for which you are eligible. The collection of information through this App and the disclosure of that information are subject to the Terms Rights and Responsibilities of the Marketplace Application and applicable law, including the Health Insurance Portability and Accountability Act (HIPAA). Except as described above or as otherwise authorized by law, the Marketplace will only collect or disclose personal information collected through this App as set forth in the Consent and Disclosure and Terms Rights and Responsibilities set forth in your Marketplace application. The Marketplace may collect or disclose personal information without your agreement for health care operations, in accordance with applicable law.

For example, information may be disclosed to federal officials to ensure compliance with a statute or regulation, or pursuant to a warrant or court order. The Marketplace may also disclose personal information to federal or state law enforcement authorities to enforce its rights against unauthorized access or attempted unauthorized access to information technology assets.

The Marketplace may disclose personal information to its agents, affiliates, and subcontractors to allow them to perform certain functions relating to your eligibility verification. We may use your information to improve the content, navigation, and efficiency of the Application.

The Marketplace does not share your personal information with unaffiliated third parties.

Application Time OutReturn to the top

For security purposes, your session is set to end after 10 minutes of user inactivity. When you are actively using the Application, you will receive a session timeout warning after 10 minutes of inactivity, allowing you to either continue your session or logout. If you do not make a selection, your session will end. If the Application is running in the background, you will be logged out after 10 minutes of inactivity.

The Marketplace retains the documentation you submit through this Application, including personal information, for a period of ten years, pursuant to applicable federal law. Through your use of this Application, we may collect information about your device, such as the device model, name, operating system, or IP address. Like most Applications, we employ "cookies" and other similar technologies for storing information and to help optimize application performance. We use required cookies (cookies that are strictly necessary for the application to work correctly) and functional cookies (cookies used for analytics and performance). We do not allow for the use of persistent cookies.

Our Application uses Adobe Analytics.. Adobe Analytics does not identify individual users or associate your IP address with any other data held by Adobe Analytics. The Marketplace safeguards the personal information it receives with operational, administrative, technical, and physical safeguards to prevent unauthorized or inappropriate access, use, or disclosure. Policies to protect the confidentiality of personal information are based on applicable law and standards for state-based health insurance marketplaces.

To protect users connecting to the App, security controls include authentication of the client mobile application, encryption, as well as monitoring and auditing.

As part of our continuing commitment to protect information these safeguards are in place, however, no application or system is totally secure. Use of this information system does hereby constitute consent to such monitoring and auditing.

We are committed to complying with the Children's Online Privacy Protection Act. Although parents are free to use this mobile Application on behalf of their children, this Application is not meant for use by children, and we do not knowingly collect personal information from children. We are pleased to work with parents and guardians to delete from our records any personal information that a child may have disclosed improperly on this mobile Application.

You are required to provide accurate, current and complete information and inform the Marketplace of any changes that may affect your application for health insurance coverage.
